Terms of Service

These Terms of Service (“Terms”) govern your access to and use of realfarmtalk.com (the “Service”), operated by realfarmtalk (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction to use the Service. By using the Service you represent that you meet this requirement.
2. Accounts
You are responsible for keeping your account credentials confidential and for any activity on your account. Tell us promptly if you suspect unauthorised access.
3. Your content
You retain ownership of articles, posts, photos, and listings you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, display, copy, transmit, and adapt the User Content solely for the purpose of operating, improving, and promoting the Service.
You represent and warrant that:
- You own or have the rights to the User Content you submit.
- It does not infringe any third-party rights (including IP, privacy, publicity).
- It is accurate, not misleading, and not unlawful, defamatory, or harassing.
4. Prohibited conduct
You agree not to:
- Post content that is illegal, fraudulent, abusive, or that you do not have rights to.
- Solicit or facilitate the sale of items prohibited in your or the buyer's jurisdiction.
- Impersonate another person, farm, or organisation.
- Scrape, harvest, or republish the directory or any data we publish without written permission.
- Interfere with or attempt to compromise the Service's security.
5. Marketplace
The marketplace is a venue for direct transactions between sellers and buyers (“Users”). realfarmtalk is not a party to any transaction, does not take possession of inventory, and does not act as an agent for any User. The Marketplace Policy sets out additional rules that apply to listing, buying, and selling.
5.1 Payment processing (forward-looking)
Where the Service later integrates a third-party payment processor (e.g. Stripe, Wise, regional PSPs), additional payment terms will appear at checkout and you must accept them to complete a transaction. We do not currently hold or transmit any payment funds.
5.2 Taxes, customs, regulatory compliance
Sellers are solely responsible for collecting and remitting any applicable taxes, for complying with customs and import/export rules, and for meeting any licensing, labelling, veterinary, biosecurity, food-safety, organic-certification, or animal welfare requirements that apply to their products in their jurisdiction and the buyer's jurisdiction. realfarmtalk does not assess or verify compliance.
6. Risk Calculator and editorial content
The Risk Calculator and any aggregate or commentary content on the Service is provided for general information only. It is not financial, legal, tax, veterinary, or agronomic advice. Decisions you make based on it are your responsibility. See the Disclaimer for the full statement.
7. Intellectual property
Except for User Content, the Service (including the brand, code, design, copy, and compilations) is owned by realfarmtalk or its licensors and is protected by intellectual-property laws. Nothing in these Terms grants you any right in the Service except the limited right to use it in accordance with these Terms.
7.1 Copyright complaints (DMCA / equivalents)
If you believe content on the Service infringes your copyright, send a written notice to legal@realfarmtalk.com identifying the work, the location of the alleged infringement, your contact details, and a good-faith statement under penalty of perjury that you are authorised to act.
8. Termination
We may suspend or terminate your account at any time for breach of these Terms or applicable law, or for protecting users or the Service. You may close your account at any time. Provisions intended to survive termination (IP, indemnity, disclaimers, limitation of liability, dispute resolution) survive.
9. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that any content is accurate or reliable.
10. Limitation of liability
To the maximum extent permitted by law, in no event will realfarmtalk (or its directors, officers, employees, or affiliates) be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, livestock, crops, or goodwill arising out of or relating to your use of the Service. Our aggregate liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim and (b) USD 100.
11. Indemnity
You agree to defend, indemnify, and hold harmless realfarmtalk and its affiliates from any claim arising out of your User Content, your use of the Service, or your breach of these Terms or applicable law.
12. Governing law and dispute resolution
These Terms are governed by the laws of [JURISDICTION], without regard to conflict of laws principles. Any dispute will be resolved exclusively in the courts of [VENUE], unless a different mandatory consumer-protection forum applies. The operator may choose to require binding individual arbitration for some disputes; if so, the arbitration clause will be added here and you may opt out per its terms.
13. Changes to these Terms
We may modify these Terms from time to time. Material changes will be announced on the Service. Continued use after the effective date constitutes acceptance.
